Privacy Policy

This Privacy Policy explains how LYST'D LLC ("Lyst'd," "we," "us," or "our") collects, uses, and shares information when you use the Lyst'd AI mobile application, website, and related cross-listing services (the "Service"). By using the Service, you agree to this Policy.

Lyst'd is an 18+ service. Do not use it if you are under 18.

1. Definitions

  • Account — your unique profile on the Service.
  • Application — the mobile app "Lyst'd AI."
  • Marketplace(s) — third-party platforms the Service connects to on your behalf, including eBay, Mercari, Depop, Poshmark, and Facebook Marketplace.
  • Listing Data — item information you upload or that we sync from a Marketplace, including titles, descriptions, categories, photos, prices, SKUs, condition notes, tags, shipping details, and sold/unsold status.
  • Marketplace Credentials — any login information, OAuth tokens, API keys, session cookies, or other authentication data required to access a Marketplace account on your behalf.
  • User Content — photos, text, and other material you submit through the Service.
  • Usage Data — data collected automatically about how you interact with the Service.
  • You — the individual using the Service.

2. Information We Collect

2.1 Account Information

When you create an Account, we collect your name, email address, phone number (if provided), password, and any optional profile details.

2.2 Marketplace Credentials and Connection Data

To cross-list on your behalf, Lyst'd must connect to your Marketplace accounts. Depending on the Marketplace, this connection is made via:

  • OAuth tokens or official API credentials issued by the Marketplace; or
  • Login credentials you provide (username and password) where no official API is available.

Credentials and tokens are stored in encrypted form and used only to perform actions you initiate within the Service. You can disconnect any Marketplace at any time from your Account settings.

2.3 Listing Data and Sales Data

When you use the Service, we collect and process:

  • Item photos, titles, descriptions, categories, prices, and shipping information
  • Listing performance data (views, favorites, offers, time to sell)
  • Sales data (sold price, sale date, Marketplace, buyer handle)
  • Messages related to a listing, only when you use in-app messaging features

We do not collect your Marketplace payout or banking information. Payouts from Marketplaces go directly to you through the Marketplace's own payment system.

2.4 Payments

All subscription payments are processed through Apple App Store (In-App Purchases) or Google Play Billing. Lyst'd does not receive or store your credit card number, billing address, or other payment card details. We receive only a transaction confirmation and subscription status from Apple or Google.

2.5 Usage Data

We automatically collect:

  • Device type, operating system, app version, language, and time zone
  • IP address and general location derived from it
  • Crash logs, error reports, and performance metrics
  • Feature usage, session length, and in-app actions

2.6 Cookies and Mobile Identifiers

Our website uses cookies and similar technologies for analytics and functionality. The Application may use mobile advertising identifiers (IDFA / AAID) and analytics SDKs. You can control these through your device settings.

3. How We Use Your Information

  1. Operate the cross-listing service — create, edit, duplicate, delist, and sync listings across connected Marketplaces on your behalf.
  2. Authenticate and maintain connections to your Marketplace accounts.
  3. Provide analytics and insights about your listings, sales, and inventory.
  4. Improve our AI and machine learning models, including models that generate or optimize listing titles, descriptions, categories, tags, and suggested pricing (see Section 4).
  5. Provide customer support and respond to your requests.
  6. Send service-related communications, such as security alerts, billing notices, and product updates.
  7. Send marketing communications where permitted, which you can opt out of at any time.
  8. Detect and prevent fraud, abuse, and Terms of Service violations.
  9. Comply with legal obligations and enforce our agreements.

4. AI and Machine Learning Model Training

Lyst'd uses Listing Data and User Content to train and improve machine learning models that power the Service, including models used for:

  • Title and description generation
  • Category and tag suggestions
  • Pricing recommendations
  • Photo enhancement and background removal
  • Cross-platform listing optimization

Your privacy in model training:

  • We use Listing Data and photos in anonymized or aggregated form for model training. Training data is stripped of your name, email, Account ID, and Marketplace usernames before being used to improve models.
  • We do not sell your data to third parties for their own AI training.
  • We do not publicly display your listings or photos outside of the Marketplaces you've chosen to post to.
  • You can opt out of having your data used for model training through your Account settings. Opting out does not affect your ability to use the core Service.

5. How We Share Information

We do not sell your personal information. We share information only as follows:

5.1 Marketplaces. When you instruct Lyst'd to post, edit, or delete a listing, we send the relevant Listing Data and authentication tokens to the applicable Marketplace(s). Each Marketplace has its own privacy policy that governs how they handle your data.

5.2 Service Providers. We use vendors for cloud hosting, database storage, analytics, crash reporting, customer support, email delivery, and security. These providers may process data on our behalf under contractual obligations.

5.3 Apple and Google. For payment processing and app distribution.

5.4 Legal and Safety. We may disclose information when legally required (subpoena, court order, government request) or to protect the rights, safety, or property of Lyst'd, our users, or others.

5.5 Business Transfers. If Lyst'd is acquired, merged, or sells assets, your information may transfer to the successor entity subject to this Policy.

5.6 With Your Consent. In any other case, only when you explicitly direct us to.

6. Third-Party Marketplaces

The Service connects to third-party Marketplaces that we do not own or control. Lyst'd is not affiliated with, endorsed by, or sponsored by eBay, Mercari, Depop, Poshmark, or Facebook Marketplace. Your use of each Marketplace is governed by that Marketplace's own Terms of Service and Privacy Policy, and you are responsible for complying with them. Some Marketplaces restrict or prohibit automated cross-listing tools, and using Lyst'd may put your Marketplace account at risk of suspension. You use the Service at your own risk.

7. Your User Content and License

You retain ownership of all User Content you submit (including photos, text, and listing details). By submitting User Content, you grant LYST'D LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, create derivative works from, and display your User Content solely to:

  • Operate and provide the Service (including pushing listings to Marketplaces you've authorized);
  • Improve the Service and train AI/ML models as described in Section 4; and
  • Provide customer support.

This license ends when you delete the User Content or your Account, except where we must retain it for legal or backup reasons.

8. Data Retention

  • Account data: until you delete your Account, then deleted within 90 days.
  • Listing and sales data: retained while your Account is active; you can delete individual listings at any time.
  • Marketplace Credentials: deleted immediately when you disconnect a Marketplace or delete your Account.
  • Anonymized model training data: may be retained indefinitely, since it is not linked to you.
  • Backups: purged on a rolling basis, typically within 90 days.
  • Legal or fraud-related data: retained as required by law.

9. Security

We use encryption in transit (TLS) and at rest, access controls, and standard security practices to protect your data. Marketplace Credentials are encrypted using industry-standard methods. No system is 100% secure, and you use the Service at your own risk. If we detect a security incident affecting your data, we will notify you as required by applicable law.

10. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate information
  • Delete your information
  • Export your data in a portable format
  • Opt out of marketing communications
  • Opt out of AI model training (see Section 4)
  • Withdraw consent where processing is based on consent

California residents: You have additional rights under the CCPA/CPRA, including the right to know what information we collect, the right to delete it, the right to correct it, and the right to opt out of "sharing" for cross-context behavioral advertising. We do not sell personal information.

EEA / UK residents: We process your data based on performance of our contract with you, your consent, our legitimate interests in operating and improving the Service, and our legal obligations. You have the right to lodge a complaint with your local data protection authority.

11. International Data Transfers

Lyst'd is based in the United States. If you use the Service from outside the U.S., your information will be transferred to, stored, and processed in the U.S. We use standard safeguards (including Standard Contractual Clauses where required) for international transfers.

12. Age Requirement

The Service is for users 18 years of age or older. We do not knowingly collect information from anyone under 18. If we learn that we have collected information from someone under 18, we will delete it. If you believe a minor is using the Service, contact Support@lysdtai.com.

13. Third-Party Links

The Service may contain links to third-party websites. We are not responsible for their privacy practices. Review their policies before sharing information.

14. Changes to This Policy

We may update this Policy from time to time. Material changes will be communicated through the App, email, or website notice at least 7 days before taking effect. Your continued use of the Service after changes take effect means you accept the updated Policy.
